Description of service

CON-Quest is a social networking platform designed for cosplayers and convention attendees. The app allows users to connect, chat, create meetups, find other cosplayers, and communicate around conventions.

User eligibility

You must be at least 18 years of age to use CON-Quest. By using the app, you represent and warrant that you are 18 or older. We do not knowingly allow users under 18.

User accounts

• You are responsible for maintaining the confidentiality of your account and password.
• You must provide accurate and complete information during registration.
• You may not create more than one account per person.
• CON-Quest reserves the right to suspend or terminate accounts at its sole discretion.

Acceptable use and Community Guidelines

You agree not to:

• Harass, bully, threaten, stalk, or intimidate other users.
• Post or send content that is abusive, obscene, hateful, discriminatory, or sexually explicit.
• Impersonate any person or organization.
• Attempt to solicit personal information from minors.
• Use the app to organize or promote illegal activities.
• Dox, share private contact information, or engage in predatory behavior.

CON-Quest has zero tolerance for child sexual abuse and exploitation (CSAE) and child sexual abuse material (CSAM). You may not use the app to create, upload, share, solicit, store, or distribute CSAM or to groom, sexually exploit, sextort, traffic, or otherwise endanger a minor. This prohibition applies to real, fictional, illustrated, and AI-generated content.

We have zero tolerance for predatory or unsafe behavior.

Safety and reporting

CON-Quest has zero tolerance for predatory behavior, harassment, abuse, or objectionable content. Users can report any content or user they believe violates these Terms or Community Guidelines using the in-app reporting tools. Users can also block other users at any time.

We review reports of objectionable content and abusive behavior and take action as appropriate, which may include content removal, temporary suspension, or permanent account termination. Serious violations may result in an immediate permanent ban.

When we obtain actual knowledge of apparent CSAM, we promptly restrict or remove the content, preserve information when legally required, suspend or terminate the associated account, and report confirmed CSAM to the National Center for Missing & Exploited Children (NCMEC) or the appropriate law-enforcement authority as required by applicable law.

User content and intellectual property

You retain ownership of content you post. By posting, you grant CON-Quest a worldwide, royalty-free, non-exclusive license to host, display, distribute, and use that content within the app for the purpose of operating, improving, and enforcing the service. You also grant us the right to moderate, remove, or restrict access to any content at our sole discretion.

Platform status

CON-Quest is a platform that allows users to share content. We are not the publisher or speaker of user-generated content. We do not endorse or guarantee the accuracy, safety, or legality of any user content or interactions.

Disclaimer of warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CON-QUEST DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CON-QUEST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

THESE LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Indemnification

You agree to indemnify, defend, and hold harmless CON-Quest, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the app, your content, your interactions with other users, or your violation of these Terms.

Dispute resolution, arbitration, and class action waiver

Before filing a claim, you and CON-Quest agree to first attempt to resolve any dispute informally by contacting the other party. You must send a written notice of the dispute to conquestapp@outlook.com. We will attempt to resolve the dispute within 45 days of receiving your notice.

If the dispute is not resolved within that period, either party may proceed to binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Hays County, Texas, or another mutually agreed location.

You and CON-Quest agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Governing law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Subject to the arbitration provision above, exclusive venue for any court proceedings shall be in Hays County, Texas.

Termination

We may suspend or terminate your account at any time, with or without cause or notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

Changes to these Terms

We may update these Terms from time to time. Your continued use of the app after changes are posted constitutes acceptance of the updated Terms.
